1. Acceptance of Terms
By accessing or using www.ezeventphoto.com, our online client galleries, or by purchasing services and products from us (online or in person at event locations), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our websites or services.
2. Business Entity & Scope
These Terms govern the websites and services operated by James V. Valentino Jr., doing business as Capital Photo. These Terms apply to all website visitors, online gallery users, event attendees, and clients purchasing photography services, digital image downloads, prints, or photo restoration services.
3. Orders, Pricing, and In-Person Retail Sales
Pricing: All prices listed on our websites, pricing sheets, or event display boards are subject to change without notice.
Finality of Sales: All sales of physical prints, custom photo products, and digital image downloads (whether purchased online or in person at mall holiday operations, car show trailers, or pop-up event registers) are final.
In-Person Retail Disclaimers: Custom physical prints and digital products delivered on-site at retail event locations are reviewed and accepted at the time of purchase. Refunds or exchanges are not provided once physical products or digital files have been handed over or transmitted.
4. Intellectual Property and Usage Licenses
Copyright Ownership: James V. Valentino Jr. DBA Capital Photo retains sole and exclusive copyright to all photographs, images, graphics, and content produced or displayed on our websites, galleries, and physical products pursuant to United States Copyright Law.
Personal Use License: Unless a formal Commercial Photography Agreement is executed in writing, all digital images and physical prints purchased from Capital Photo are granted under a limited, non-exclusive, non-transferable, personal-use license. You may display prints and share purchased digital images for personal, non-commercial purposes.
Restrictions: You may not copy, edit, alter, resell, license, or use any images for commercial advertising, marketing, or resale without explicit prior written authorization from Capital Photo. Photographs depicting vehicles, logos, or public event setups do not include commercial licensing or trademark releases unless explicitly contracted.
5. Client Galleries and Digital Delivery
Gallery Expiration: Online client viewing and download galleries remain active for 30 days following delivery, or as otherwise specified in a custom job contract.
Download and Retention Responsibility: Clients are solely responsible for downloading and backing up their purchased digital image files within the applicable active gallery period. Capital Photo is under no obligation to archive, retain, or recover digital files after the gallery expires.
6. Text Messaging & SMS Terms (Toll-Free & Carrier Compliance)
By opting in to receive SMS notifications, appointment reminders, gallery alerts, or customer service updates from Capital Photo, you agree to the following SMS Terms:
Consent & Opt-In: Capital Photo sends transactional text messages only to contacts who affirmatively select the optional transactional SMS consent checkbox. These messages may include account and payment notifications, appointment reminders, event updates, gallery access links, and order or delivery updates. Marketing text messages, including seasonal photography promotions and special offers, are sent only to contacts who separately select the optional marketing SMS consent checkbox. Both checkboxes are unchecked by default. Consent is not a condition of purchase or form submission.
Rates & Frequency: Standard message and data rates may apply. Message frequency varies based on your activity and the message types you opt in to receive. Carrier Disclaimer: Wireless carriers are not liable for delayed or undelivered messages.
Opt-Out & Help Instructions: You may cancel or opt out of SMS messages at any time by texting STOP to any message received. Reply HELP for customer support assistance, or contact [email protected].
Privacy & Data Protection: No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Your SMS consent data is governed by Section 5 of our Privacy Policy.
7. User Conduct and Prohibited Activities
You agree not to:
Circumvent, disable, or interfere with security features or gallery access controls on our websites.
Screenshot, download, or extract unpurchased proof images, watermarked previews, or site assets.
Use automated tools, scrapers, or bots to harvest data or images from our domains.
Use our contact forms, email addresses, or phone lines to send unsolicited commercial marketing (spam).
8. Limitation of Liability
To the maximum extent permitted by applicable law, James V. Valentino Jr. DBA Capital Photo shall not be liable for any indirect, incidental, special, or consequential damages resulting from the use or inability to use our websites, galleries, or services, or for the loss of digital files after the applicable gallery availability period has expired. Our total cumulative liability for any claim arising out of or relating to our services shall not exceed the total amount paid by you to Capital Photo for the specific transaction in question.
9. Governing Law and Disputes
These Terms are governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Saratoga County, New York.
10. Changes to Terms
We reserve the right to update or modify these Terms at any time. Changes will be effective immediately upon posting to our websites with an updated "Effective date." Your continued use of our websites or services after changes are posted constitutes acceptance of the modified Terms.
